Popular Canadian legal questions, answered
How do I apply for a protection order or peace bond against a partner or family member?
If you are in immediate danger, contact emergency services first. Otherwise, ask about both a criminal peace bond and the civil protection route in your province. They have different eligibility rules, forms and urgency tests; a previous criminal conviction is not generally required. Prepare specific facts, preserve evidence safely and explain why protection is needed now. Ask the court about applying without notice where warning the other person would create danger. Obtain help with safe service, precise conditions and the next hearing date.
Someone crashed into my car. Who pays for the damage, and what if the other driver is uninsured?
Report promptly to your own insurer. Alberta already uses direct compensation property damage for qualifying crashes: your insurer pays the covered not-at-fault share. A two-car crash with an uninsured other vehicle does not qualify; check your optional coverage and any claim against a legally responsible person. An unidentified hit-and-run also needs a coverage check. Comprehensive may respond when your car was struck while not in use or operation. DCPD deletion endorsements, deductibles, evidence and deadlines matter. MVAC does not pay for property damage.
Someone crashed into my car. Who pays for the damage, and what if the other driver is uninsured?
Report the crash to ICBC promptly and check your own coverage. In a qualifying BC road collision, Basic Vehicle Damage covers the eligible damage share for which you are not responsible, with a $200,000 vehicle limit. An identified uninsured driver does not automatically defeat that coverage. An unidentified hit-and-run is different: check purchased collision or Hit and Run coverage and its deductible. Preserve evidence before repairs. Fault disputes and vehicle-value disputes follow different procedures and deadlines; do not let informal discussions run down those clocks.
